Loyalty Club Terms & Conditions

1. Definitions

Unless the context otherwise requires in these terms and conditions:

BIG4 means BIG4 Holiday Parks of Australia Pty Ltd;
BIG4 Holiday Park or BIG4 Park means a holiday park operated by a franchisee of BIG4;
BIG4 Loyalty Club means loyalty program owned and administered by BIG4 under the name "BIG4 Loyalty Club" or such other name determined by BIG4 from time to time;
BIG4 Loyalty Club Benefits Partner means a person who has agreed with BIG4 to make an offer to BIG4 Members for the purpose of clause 6;
BIG4 Loyalty Club Card means a card that may be issued by BIG4 to a BIG4 Member, which is valid for the Membership Period, and identifies the BIG4 Member's Membership in the Program, and which may also identify the BIG4 Member's Status;
BIG4 Member means an individual whose application to join the BIG4 Loyalty Club has been accepted by BIG4;
Blue Status means the Status so determined in accordance with clause 4.4;
Gold Status means the Status so determined in accordance with clause 4.4;
Membership Period means, unless otherwise terminated in accordance with these terms, the period of time stipulated in clause 3 during which a BIG4 Member's Membership is active;
Membership Saving means a discount on accommodation booking with participating BIG4 Holiday Parks pursuant to clause 5;
Program means the BIG4 Loyalty Club;
Status means the level of BIG4 Membership for the purpose of determining a BIG4 Member's entitlement to benefits under the Program;
Status Credit means a credit awarded by BIG4 to a BIG Loyalty Club Member in accordance with clause 4, and by which a BIG4 Loyalty Club Member's status for the purpose of receiving certain benefits under the Program are determined.

2. Applicability

a. BIG4 Loyalty Club benefits are available to you if you are a current BIG4 Member with Membership fees fully paid at the time the benefit accrues or is otherwise available.
b. The BIG4 Loyalty Club benefits set out below apply for tourist use only (i.e. applies to anyone other than a permanent park resident or annual park resident maintaining a permanent site within the park). Permanent and annual residents are excluded.
c. You acknowledge that:
i. each BIG4 Holiday Park is operated by a franchisee pursuant to a franchise right granted by BIG4; and
ii. each BIG4 Loyalty Club Partner is an independent contractor who has no other relationship with BIG4, and that each is not permitted to make any representation for, and is unable to bind, BIG4.
d. BIG4 Membership is personal to you and is not transferable, assignable or refundable. Further, BIG4 Membership cannot be converted into cash.
e. There is a strict limit of one (1) BIG4 Membership per person.
f. The laws of Australia apply to these Membership Terms and Conditions to the exclusion of any other law. Individuals submit to the exclusive jurisdiction of the courts of Australia.

3. Membership Period

Membership lasts for a period of two years only, but may be renewed for a new Membership Period each time on payment of the renewal fee payable at the time of renewal. Renewal is not permissible unless within six (6) months of the due expiry date. During any period where the relevant Membership fee has not been paid by the BIG4 Member, the BIG4 Member will not be entitled to any benefits of BIG4 Membership, including:

a. accruing any Status Credits;
b. any Membership Savings; and
c. claiming any benefit available from a BIG4 Loyalty Club Benefits Partner.

4. Membership Status Credits & Membership Levels

4.1    Award of Status Credit

a. Subject to 4.1(c) below, a Status Credit is awarded to the BIG4 Member in whose name the accommodation is booked for every night stay at a BIG4 Holiday Park by a BIG4 Member where the total stay is paid for in full by that BIG4 Member, in accordance with the below:
1. Four (4) Status Credits are awarded for every night stayed in a BIG4 Holiday Park cabin.
ii. One (1) Status Credit is awarded for every night stayed on a BIG4 Holiday Park site (powered, unpowered or ensuite).
iii. Status Credits will only accrue to one BIG4 Member. If the booking is in the name of more than one BIG4 Member, the Holiday Park may nominate which BIG4 Member to whom Status Credits will be awarded in the absence of agreement by the relevant BIG4 Members.
b. A Member may not earn more than 44 Status Credits per stay per Holiday Park. Consecutive nights at the same Holiday Park will comprise one stay, regardless of the BIG4 Member making more than one booking or checking in more than once.
c. If a Member books more than one site or cabin for the same night, Status Credits will only be awarded to one accommodation type, of the highest value.
d. Status Credits are awarded to the BIG4 Member's account upon checkout of the BIG4 Holiday Park accommodation.
e. The number of Status Credits awarded and the expiry period of Status Credits for eligible purchases may change from time to time without prior notice to BIG4 Members unless prior notice is reasonable in the circumstances.
f. Status Credits can only be awarded to the BIG4 Member described in clause 4.1(a) and cannot be reallocated, combined or transferred to another party or BIG4 Member.
g. Any Status Credit, rewards, discount offers or entitlements accrued under the BIG4 Membership are not transferable or exchangeable and cannot be taken as cash.
h. BIG4 reserves the right to substitute an alternative reward or benefit of equivalent value in the event that any reward or entitlement is not available.

4.2 Review of Status Credit History:

A BIG4 Member can view the amount of Status Credits they have accumulated at any stage by signning into My Membership.

4.3. Expiration of Status Credits

A Status Credit will expire two years after it is earned, subject to clauses 4.4, 4.5 and 4.6.

4.4. Membership Levels

Two BIG4 Membership Status levels exist as outlined below:

a. Blue Status: Unless the BIG4 Member qualifies for Gold Status, the BIG4 Member will have Blue Status. A BIG4 Member will be given Blue Status on becoming a BIG4 Member.
b. Gold Status:
i. A BIG4 Member with Blue Status will be elevated to Gold Status once their BIG4 Membership Account has reached a balance of 100 Status Credits during the Membership Period.
ii. Once Gold Status has been earned, a new BIG4 Loyalty Club Card, identifying the BIG4 Member's Gold Status.
iii. For the avoidance of doubt, a change in a BIG4 Member's Status will not affect the Membership Period or the expiry date of the BIG4 Member's Membership.
iv. If a BIG4 Member with Blue Status is elevated to Gold Status, then 100 Status Credits will be deducted from their balance of Status Credits immediately after reaching Gold Status.

4.5 Membership Renewal – Renewal of Membership BEFORE the expiry date OR within the PERIOD OF 6 MONTHS FOLLOWING THE EXPIRY DATE

a. BIG4 Members with Blue Status: If a BIG4 Member with Blue Status accrues less than 100 new Status Credits within the Membership Period, and renews their Membership before the expiry date of that Membership Period or within the six (6) months following the expiry date of that Membership Period, then:
i. the new Membership Period will commence immediately following the expiry of the previous Membership Period;
ii. the BIG4 Member will continue as a BIG4 Member with Blue Status after renewal of their Membership;
iii. the BIG4 Blue Member will retain any Status Credits they gained over their Membership Period (which have not naturally expired in accordance with clause 4.3); and
iv. the BIG4 Member will retain the same Membership number.
b. BIG4 Gold Member for LESS than 2 years: If a BIG4 Member who has held Gold Status for LESS than 2 years, and renews their Membership before the expiry date of that Membership Period or within the six (6) months following the expiry date of that Membership Period, then:
i. the new Membership Period will commence immediately following the expiry of the previous Membership Period;
ii. the BIG4 Member will continue as a BIG4 Member with Gold Status after renewal of their Membership (regardless of the number of Status Credits he/she has at the time of renewal);
iii. 100 Status Credits will be deducted from their balance of Status Credit immediately after reaching Gold Level Status; and
iv. the BIG4 Member will retain the same Membership number.
c. BIG4 Gold Member for 2 years or MORE and obtained less than 100 credits: If a BIG4 Member who has held Gold Status for 2 years or more and obtains less than 100 credits during the then current Membership Period, and renews their Membership before the expiry date of the Membership Period or within the six (6) months following the expiry date of the Membership Period, then:
i. the new Membership Period will commence immediately following the expiry of the previous Membership Period;
ii. the BIG4 Member will revert to Blue Status;
iii. nevertheless, the BIG4 Member will retain any Status Credits they gained over their Membership Period (which have not naturally expired in accordance with clause 4.3); and
iv. the BIG4 Member will retain the same Membership number.
d. BIG4 Gold Member for 2 years or MORE and obtained 100 credits or more: If a BIG4 Member who has held Gold Status for at least immediately preceding 2 years, obtains at least 100 Status Credits during the then current Membership Period, and renews their Membership before the expiry date of the Membership Period or within the six (6) months following the expiry date of the Membership Period , then:
i. the new Membership Period will commence immediately following the expiry of the old BIG4 Gold Membership;
ii. the BIG4 Member will retain Gold Status for the next Membership Period;
iii. 100 Status Credits will be deducted from their balance of Status Credit at the commencement of that new Membership Period (which have not naturally expired in accordance with clause 4.3); and
iv. the BIG4 Member will retain the same Membership number.

4.6 Membership Renewal – Renewal of Membership MORE THAN 6 MONTHS AFTER THE EXPIRY:

If a BIG4 Member renews their BIG4 Membership more than 6 months after the expiry date of the Membership Period then:

a. the commencement date of the new Membership Period will be the renewal date, rather than the date immediately following the expiry date of the previous Membership Period;
b. the BIG4 Member's balance of Status Credits will be re-set to zero as the commencement of the new Membership Period;
c. the BIG4 Member's Status level will be Blue Status; and
d. the BIG4 Member will retain the same Membership number.

5. BIG4 Membership Savings

a. BIG4 Members are offered a Membership Saving on accommodation rates at participating BIG4 Holiday Parks subject to certain conditions as described herein.
b. Membership Savings are not available to be used in conjunction with any other discount, promotion or package offered by BIG4, a BIG4 Holiday Park or other third party.
c. The Membership Saving is for one site or one cabin per BIG4 Holiday Park per stay, being:
i. for a BIG4 Member with Blue Status, a 10% discount to a maximum of $40 per stay; and
ii. for BIG4 Member with Gold Status:
(A) a 10% discount per stay (uncapped); and
(B) a gift determined by BIG4 upon reaching Gold Status for the first time.
d. The BIG4 Membership Saving may be claimed at any participating BIG4 Holiday Park.
e. To obtain the BIG4 Membership Saving, bookings must be made directly with the participating BIG4 Holiday Park at which accommodation is sought or by booking via BIG4's website http://www.big4.com.au.
f. BIG4 does not guarantee the availability of accommodation at any particular time or location.
g. In order to claim the BIG4 Membership Saving, the BIG4 Member in whose name the accommodation is booked must also quote that Member's valid BIG4 Membership number as printed on the BIG4 Loyalty Club Card at the time of check in.
h. Bookings made through agents or other intermediaries such as third party booking sites are not eligible for the BIG4 Membership Saving.

6. BIG4 Loyalty Club Benefits Partners

a. In addition to the BIG4 Membership Saving, benefits are also available to BIG4 Members from BIG4 Loyalty Club Benefits Partners. To claim benefits from BIG4 Loyalty Club Partners, the BIG4 Member must present a valid BIG4 Loyalty Club Card to the BIG4 Loyalty Club Partner. In the event that the transaction is being made by phone or via the internet, the BIG4 Member or representative must give details of the BIG4 Member's valid Membership to the relevant BIG4 Loyalty Club Partner at the time of the relevant transaction. If details of Membership are not provided to the relevant BIG4 Loyalty Club Partner at the time of purchase or redemption (unless specified otherwise), the BIG4 Member will not be entitled to claim the benefit on offer.
b. Any benefit offered by a BIG4 Loyal Club Benefits Partner is subject to availability and any terms and conditions determined by the BIG4 Loyalty Club Benefits Partner.
c. Each BIG4 Loyalty Club Benefits Partner may change, cancel or vary their offer to BIG4 Loyalty Club Members without notice.
d. BIG4 does not guarantee the availability of any benefit promoted in connection with a BIG4 Loyalty Club Benefits Partner.
e. BIG4 may receive a payment from the BIG Loyalty Club Benefits Partner in connection with the promotion of the benefit or its redemption by a BIG4 Member.

7. Money Back Guarantee

a. BIG4 Club Members enjoy a Money Back Guarantee.
b. If a Member is not fully satisfied with the facilities or service of a BIG4 Holiday Park within one hour of check-in, the cost of accommodation will be cheerfully refunded.
c. In order to receive a refund, Park reception must be notified within one hour of check-in that the accommodation is unsatisfactory. Guests must check out of the Park at that time.
d. This is an exclusive offer for BIG4 Club Member

8. BIG4 Loyalty Club Card

a. Any BIG4 Loyalty Club Card issued by BIG4 remains the property of BIG4. The BIG4 Member must exercise reasonable care for it and return or destroy it at the request of BIG4.
b. Should a BIG4 Member have a reasonable basis to require a replacement BIG4 Loyalty Club Card, BIG4 will use reasonable endeavours to replace it. A temporary card may be obtained from a BIG4 Holiday Park or is available to print from the BIG4 Membership portal (www.big4.com.au/loyalty). Any replacement BIG4 Loyalty Club Card will be sent to the BIG4 Member's address registered to their BIG4 Membership account.
c. For the avoidance of doubt, the BIG4 Loyalty Club card is not a credit card, EFTPOS card or any other card giving rise to the access of cash.

9. Termination or Suspension of Program

a. BIG4 gives no warranty as to the continuing availability of the Program. BIG4 may cancel, terminate, modify or suspend the Program for any reason, including but not limited to, the Program unable to be run as planned, for example, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of BIG4 which corrupts or affect the administration security, fairness, integrity or proper conduct of this Program.
b. In the event that BIG4 chooses to end or suspend the Program, BIG4 will give at least 6 months' notice to BIG4 Members of such termination or suspension, except if BIG4 ceases to operate a holiday park franchise system in which case the Program will cease immediately.

10. Change of Benefits

a. Subject to clause 9(b), BIG4 may make any changes to the Program, including changing these terms and conditions, the BIG4 Membership Saving or the participating BIG4 Loyalty Club Partners.
b. BIG4 will use best efforts to advise BIG4 Members of material changes to these terms and conditions and, where such changes will limit benefits available to BIG4 Members:
i. where the benefit is provided by BIG4 Holiday Parks, to give BIG4 Members at least 6 months' notice;
ii. where the benefit is provided by a third party, where possible give BIG4 Members at least 30 days' notice.
c. Without limiting this clause 9 in any way, BIG4 Members will be taken to have received the notice referred to in clause 9(b) if BIG4 notifies BIG4 Members of the change by providing notice at the address or e-mail address provided to BIG4 by the BIG4 Member.

11. Collection of Information

BIG4 collects and uses personal information in accordance with its Privacy Policy. In addition, BIG4 collects an individual's personal information from that person's BIG4 Membership application, any revisions of that information made by or on behalf of the BIG4 Member, any bookings made by a BIG4 Member where the BIG4 Member's Membership number is used, and from BIG4 Loyalty Club Benefits Partners when the BIG4 Member deals with them in connection with your BIG4 Membership. BIG4 collects that personal information in order to conduct and administer the Program, as well as processing accommodation bookings, conducting research about the Program, and developing and marketing goods and services. BIG4 may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and reward and/or entitlement suppliers. If the information requested is not provided, the individual may not participate in the Program or receive the benefits otherwise available under the Program. By participating in the Program, unless otherwise advised by the individual, each individual also agrees that BIG4 may use their personal information, for profiling and research. A request to access, update or correct any information should be directed to BIG4 at the address set out below.

12. Member Disqualification

a. BIG4 reserves the right, at any time, to verify the validity of BIG4 Members (including the personal details), and their balance of Status Credits, and to disqualify any BIG4 Member who tampers with their account balance, including but not limited to use of software or any other mechanical means that allows a BIG4 Member to automatically acquire Status Credit. Errors and omissions may be accepted at BIG4's discretion. Failure by BIG4 to enforce any of its rights at any stage does not constitute a waiver of those rights.
b. If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of BIG4, including but not limited to technical difficulties, unauthorised intervention or fraud, BIG4 reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any BIG4 Member.

13. Liability

a. BIG4 acknowledges that certain laws imply terms, conditions or warranties or otherwise impose statutory guarantees that may apply to the Program. Clauses 12(b)and 12(c) is not intended to exclude or restrict the application of such laws.
b. Subject to clause 12(a), BIG4 and any of their officers, employees or agents are not liable for any loss or claim of any kind (including, without limitation, consequential or economic loss or loss of profits), arising under or in connection with the Program, including, without limitation, any changes to the Program, save to the extent that such loss or claim arises from the negligence or wilful misconduct of BIG4 or any of their officers, employees or agents.
c. The BIG4 Membership Saving and the benefits available from the BIG4 Loyalty Club Partners are supplied by independent suppliers. Certain statutory warranties, conditions or guarantees may apply to these benefits. Nothing in these terms and conditions is intended to exclude or restrict the application of such warranties, conditions and guarantees but BIG4 makes no guarantee, warranties or representations of any kind, express or implied, with respect to the Membership benefits including warranties of merchantability, fitness for a particular purpose or otherwise outside of the application of those laws.
d. BIG4 shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of accrual of Status Credits, accepting a reward or other entitlement or using a discount offer or entitlement under the Program, except for any liability which cannot be excluded by law.
e. BIG4 will not be held responsible for any tax liability incurred by a BIG4 Member in connection with this Program, in relation to any reward, discount or entitlement offered.
f. BIG4 will not be held liable for any technical errors or issues associated with crediting Status Credits onto a BIG4 Member's BIG4 Loyalty Club Card and/or account.
g. BIG4 will not be held liable for any communication to any Member that is late, lost or misdirected for any reason, including but not limited to, spam filters operating on a BIG4 Member's email account or other system configuration problems.
h. BIG4 will not be held liable for any technical errors or issues associated with crediting Status Credits into a BIG4 Member's account and/or BIG4 Loyalty Club Card.
i. BIG4 is not responsible for any problems or technical malfunction of any telephone network or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any website or intranet site, or any combination thereof, including (but not limited to) any injury or damage to a BIG4 Member's or any other person's computer related to or resulting from participation in or downloading any materials in this Program.
